Our affiliate, Plan Compliance Services, Inc. established the industry's first 403(b) Pooled Employer Plans in early 2023 and changed that industry forever. Pooled Employer Plans can allow for a dramatic and measurable reduction in plan sponsor fiduciary oversight duties and liabilities while retaining plan design flexibility and adding many operational efficiencies.
We have been working with Professional Employer Organizations (formerly known as "employee leasing" firms) since the early 1990's. In 2002, the Internal Revenue Service's Rev. Proc. 2002-21 mandated that PEO's must utilize a 'multiple employer plan' format for retirement plans that they sponsor on behalf of their client organizations. We continue to be very active in the PEO industry and are working with many of them in establishing Pooled Employer Plans to transfer much of their liability and to accomodate their ASO clients in a retirement plan!
